Clarification Text Regarding Commercial Electronic Messages

1. Purpose

This text has been prepared in accordance with the Law on Protection of Personal Data No. 6698 (“KVKK”). Gamze Gezer Yener (“Studio GG” or “Company”) informs the relevant persons about the purposes of processing personal data, methods of collection, legal bases, transfer to third parties, and rights regulated in Article 11 of the KVKK. In this context, clarification is provided for individuals who will be contacted for commercial communication and to whom commercial electronic messages will be sent.

2. Scope

This clarification text covers the information provided to individuals who will be contacted for commercial communication and to whom commercial electronic messages will be sent via the Studio GG website.

3. Definitions and General Information

  • KVKK: Refers to the Law on Protection of Personal Data No. 6698.

  • Personal Data: Encompasses any information relating to an identified or identifiable natural person. For example, data used to identify a person, such as identity, contact, and financial information, falls within this scope.

  • Commercial Electronic Message: Messages with sound, image, or data content sent electronically for commercial purposes using tools such as telephone, call center, fax, automatic dialing systems, smart voice recording systems, e-mail, SMS.

  • Commercial Electronic Message Management System (IYS): The system that enables obtaining commercial electronic message consents, exercising the right to refuse, and managing complaint processes.

  • Commercial Communication: Any communication activity aimed at generating income within the scope of professional or commercial activities related to electronic commerce.

  • Processing of Personal Data: Refers to any operation performed on personal data, such as obtaining, recording, storing, using, and transferring.

  • Data Controller: The natural or legal person who determines the purposes and methods of processing personal data and is responsible for the establishment and management of the data recording system.

  • Relevant Person: Refers to the natural person whose personal data is processed.

4. Purpose of Processing Personal Data, Parties to Whom it Will be Transferred, and Transfer Process

Within the scope of commercial communication activities and sending commercial electronic messages;

  • Identity Information: Name, surname

  • Contact Information: Phone number, e-mail address

  • Transaction Security Information: Records related to your commercial electronic message preference and verification code

  • Marketing Information: Shopping history, information obtained during campaign processes

are processed for the purpose of carrying out advertising, campaign, promotion and promotional activities.

Transfer Details

  • To email servers and message centers to ensure business continuity,

  • To third parties from whom verification services are received for information security purposes,

  • To IYS for the creation of Message Management System (IYS) records, to third parties providing support, and to relevant public institutions such as the Ministry of Commerce,

  • To authorized bodies such as courts, public prosecutors, or to private law persons such as lawyers, mediators, when legal processes need to be carried out,

  • To relevant third parties or authorized persons for the management of requests and complaint processes

your personal data may be transferred.

Verification of Contact Information

A link or verification code will be sent to your specified e-mail address or mobile phone number to verify the contact information received from you. Therefore, your contact information will be transferred to the relevant service providers. If the e-mail server you use is located abroad, your personal data will be transferred abroad. If you do not wish to consent to the transfer of data abroad, you must ensure that your e-mail server is located in Turkey.

Right to Consent and Withdraw Consent

If you consent to commercial communication and commercial electronic messages using the verification code, you allow the sending of SMS or e-mails containing marketing, campaign, promotion, and promotional content. You can withdraw your consent at any time without giving any reason and terminate the related data processing.

5. Methods of Collection and Legal Grounds for Personal Data

Your personal data is collected through verbal, written, or electronic methods from the information you provide during membership processes on Studio GG's digital platforms, during the use of the website, and during services provided electronically or face-to-face.

  • Transaction security data is processed based on the legal ground of "it is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject" within the scope of KVKK Article 5/2-f.

  • Your other personal data is processed with your explicit consent in accordance with KVKK Article 5/1.

If you shared your electronic communication information during the purchase of products or services from our Company before 01.05.2015, this information is considered approved in accordance with Temporary Article 1(2) of the Regulation on Commercial Communication and Commercial Electronic Messages. Commercial messages to be sent within this scope will be processed based on the legal grounds of "explicitly foreseen in laws" and "explicit consent."

Granting permission for commercial electronic messages is entirely up to your preferences. Not granting message permission does not prevent you from benefiting from the services offered by Studio GG. You can continue to benefit from the services even if there is no commercial electronic message permission.

E-newsletter subscriptions, SMS deliveries, and e-mail notifications are considered within the scope of commercial electronic message activities.

In addition, the processing of your personal data for the purpose of following up and executing legal affairs;

  • KVKK Art. 5/2-a "explicitly foreseen in laws",

  • KVKK Art. 5/2-ç "it is mandatory for the data controller to fulfill its legal obligation",

  • KVKK Art. 5/2-e "it is mandatory for the establishment, exercise or protection of a right",

  • KVKK Art. 5/2-f "it is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject"

is carried out based on legal grounds.

6. Rights of the Data Subject

Regarding your personal data, you have the following rights under Article 11 of the Personal Data Protection Law No. 6698:

  • To learn whether your personal data is being processed,

  • To request information if it has been processed,

  • To learn the purposes of processing your data and whether it is used in accordance with its purpose,

  • To request correction of incomplete or incorrectly processed data,

  • To request the deletion or destruction of your personal data under the conditions stipulated in the legislation,

  • To learn about third parties to whom your data has been transferred,

  • To request compensation for damages if you suffer damage due to unlawful processing of your data.

You can exercise these rights by applying to us in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller.

7. Changes to the Policy

Studio GG reserves the right to make changes to this Clarification Text Regarding Commercial Electronic Messages when deemed necessary. Changes made become effective from the moment they are published on our website and are always accessible to users.
